What is an Alabama Health Studio Bond?

An Alabama Health Studio Bond is a surety bond that acts as a financial guarantee for those harmed by an Alabama health studio’s breach of contractor or bankruptcy. GThese bonds are required by the state to protect the public under Alabama Code Title 8-23-3.

How Does an Alabama Health Studio Bond Work?

An Alabama Health Studio Bond is a three-party agreement. The health studio is referred to as the principal on the bond. The principal pays a third-party called the surety bond company, or surety for the bond and agrees to indemnify them against losses. The surety then provides a financial guarantee to the State of Alabama Consumer Division of the Office of Attorney General (the Division), who is referred to as the Obligee. The bond is conditioned so that any buyer of health studio services may file a claim against the bond if the health studio breaches their contractor or files bankruptcy. Basically, the bond protects members of a health studio against the return of unearned membership dues if the studio does not refund them, or if the studio files for bankruptcy.

Should a claim occur, the surety will investigate the claim and pay the member if the claim is valid. The bond protects members because it should be easier to collect from licensed and rated surety bond companies instead of trying to collect from the health studio through civil or bankruptcy proceedings. Members should be aware that the bond may not be enough to cover all dues owed, however. 

Should the bond company pay a claim, they may seek reimbursement from the health studio under the indemnity agreement. Health studio owners should understand that these bonds are not insurance, although they are often written by insurance companies. 

Who Needs an Alabama Health Club Bond?

Alabama requires that every health studio that sells contracts to be rendered at a health studio facility, or any health studio under construction needs to purchase a surety bond. According to Alabama code, a Health Spa is defined as:

“Includes any person, firm, corporation, organization, club, or association
engaged in the sale of instruction, training, or assistance in a program of physical exercise or
weight reduction, which may include the use of a sauna, whirlpool bath, weight lifting room,
massage, steam room, or other exercising or weight reduction machine or device. The term also
includes any person, firm, corporation, organization, or association engaged in the sale of the
right or privilege to use exercise or weight reduction equipment or facilities, such as a sauna,
whirlpool bath, weight lifting room, massage, steam room, or other exercising or weight
reduction machine or device.”

Exceptions to Health Club Definition

Non-profit organizations that have been granted tax exempt status from the IRS are not considered health studios under Alabama code when their health studio services are only incidental to the organization’s other activities. 

What is the Required Amount of an Alabama Health Studio Bond?

Alabama requires health studios to provide a health studio bond or alternative in an amount of not less than $50,000. The amount on the bond is the most the surety bond company has to pay, regardless of the number of claims filed, the amounts of claims filed, or the number of years the surety has written the bond.
